EA Expert Network participation terms

Terms for expressly agreed participation in the EA Expert Network.

As of 18 September 2026. These terms apply where EA and the participant expressly agree to them. Publication and registration alone do not replace that agreement.

1. Provider and scope

The provider is EA European Atlantic GmbH, Neuer Wall 10, 20354 Hamburg, Germany, represented by Daniel Harbeck, registered with Amtsgericht Hamburg under HRB 168599, mail@european-atlantic.com.

These terms concern registration of project experts and candidates with European Atlantic, HARBECK & PARTNER and HEAVY CAMPAIGNS, within the expressly selected area. Anyone representing a company must be authorised to do so. An engagement to arrange employment, a project assignment or another separate service requires a separate agreement; registration does not replace it.

2. Registration and scope of service

EA enables submission of a professional profile and discussion of possible project or employment opportunities. Registration and inclusion in the optional expert pool are free of charge. Any paid service requires a separate agreement before it is commissioned.

A participation agreement is formed through corresponding express declarations by you and EA. A technical receipt or email confirmation confirms only receipt or technical verification. Acknowledging that you have read a privacy notice does not constitute agreement to these contractual terms. Your privacy rights and the handling of your registration apply independently of such a participation agreement.

There is no entitlement to admission, project proposals, customer presentations or an assignment. You need not accept a proposal or work exclusively with EA. Registration or pool admission alone creates no entitlement to remuneration or placement and no promise of a project, employment or successful placement.

In particular, registration does not create a placement fee payable by candidates. Any separate paid placement agreement with a person seeking employment must comply with the applicable statutory form and remuneration requirements. Mandatory consumer rights remain unaffected.

3. Profile and submitted documents

Your information should be accurate, relevant and current. Please tell us about material changes, such as availability or contact details. Submit only documents that you may lawfully use and share for the stated purpose. Omit or remove unnecessary third-party information and trade secrets for which you have no relevant authorisation.

You grant EA only the non-exclusive rights in submitted documents necessary to handle registration, permitted pool use and a customer presentation confirmed by you. This covers necessary copies and factual formatting, not distortion of content or unrelated exploitation. Rights are limited to the permitted purposes and their necessary duration. This does not authorise public publication, sale of your data or AI-model training.

4. Pool and customer presentations

Pool participation is voluntary and governed by your separate consent. Accepting these terms replaces neither consent nor your confirmation for a specific customer presentation.

Before transmitting an identifiable profile, EA informs you about the specific project or employment opportunity, intended recipient and information proposed for disclosure. Presentation occurs only after your confirmation. Confirmation does not oblige you to accept a project and creates no automatic payment obligation. Scope, remuneration, duration and other project terms are agreed separately.

5. Confidentiality and permitted use

Both parties keep non-public information recognisable as confidential from the relationship confidential and use it only for the stated purpose. Necessary recipients must be bound to that purpose and confidentiality. Exceptions apply to information lawfully public, already lawfully known or independently developed, and to legally required disclosures. Legally protected reporting to competent bodies remains permitted. Confidentiality continues after participation ends for as long as a legitimate confidentiality interest remains.

Personal verification credentials must not be shared with unauthorised people. Inform EA if you suspect unauthorised use. Submitting other people’s profiles without authority, unlawful content, accessing other people’s data and activities that harm the service or others are prohibited. This does not restrict legitimate privacy requests.

6. Availability, restrictions and termination

Uninterrupted availability at all times is not agreed. Email contact remains possible during service interruptions. EA may take necessary, proportionate protective measures and temporarily restrict use where there are concrete indications of misuse. Where lawful and possible without undermining protection, EA informs you of the reason and options to resolve it and considers your response.

You may terminate participation at any time without notice by email. EA may terminate on 14 days’ notice in text form. Both parties retain the right to terminate for good cause without notice. Existing individual project orders do not automatically terminate as a result.

Termination ends active network support. Retention, erasure and handling of information already lawfully disclosed follow the privacy notice and applicable law. Termination does not restrict withdrawal or erasure rights. Further pool contact stops after termination; renewed participation requires a new clear basis.

7. Liability

EA has unlimited liability for intent and gross negligence, injury to life, body or health, an expressly assumed guarantee and mandatory statutory liability. For ordinary negligence, EA is liable for breach of essential contractual duties that enable proper participation and on which you may regularly rely; liability is limited to loss typical of the contract and foreseeable when it was concluded. Otherwise, liability for ordinary negligence is excluded. Mandatory claims, particularly under data-protection law, remain unaffected.

8. Changes and final provisions

Changes to this participation agreement require agreement. Merely publishing a new version or your silence does not constitute acceptance. Individually agreed provisions prevail. German law applies, without prejudice to mandatory protective rules. Statutory court jurisdiction is not restricted.

Privacy information describes processing of your data and is not blanket contractual permission to process it. The German and English versions are intended to have the same meaning. Any discrepancy is clarified and is not treated as extending your obligations or consent.
